Elon Musk asks to postpone the lawsuit over Twitter to November: lawsuit




Musk and Twitter have filed a lawsuit in a Delaware court, with a five-day lawsuit due to begin on October 17.

Twitter wants the court to order Musk to close the deal at $54.20 a share, while Musk wants him to be able to walk away without paying a $1 billion severance package, claiming Twitter has breached the contract.

Musk asked the judge to allow both sides to proceed with their cases until November 10, after which a conference will be held to discuss what evidence they can present in court. He said the trial could begin later this month “subject to the possibility of a trial.”

Musk sued Twitter in July and accused the company of fraud for misleading him about the amount of spam on the platform in its securities filings. He also claimed that Twitter violated the contract and the Texas Securities Act.

Earlier Tuesday, a regulatory filing revealed that Musk sent an additional letter to Twitter announcing the termination of the agreement, which included a recent whistleblower complaint from the social network’s former security chief as another reason for terminating the agreement.
