Mexico: banning electronic cigarettes is unconstitutional – sciences et Avenir

The ban on electronic cigarettes is unconstitutional in Mexico, the Supreme Court of Justice of the Nation ruled this Tuesday, invoking the principle of “commercial freedom.”

The highest judicial body in the country thus annuls an article of the general tobacco law that prohibited the sale of vapers in Mexico.

In detail, the Court annulled the article of law that prevented “marketing, selling, distributing, promoting or producing any object that is not a tobacco product, but that contains elements that identify it with tobacco products.”

This article of law established “an absolute and categorical prohibition that violates commercial freedom,” the Supreme Court said in a statement.

“However, the Supreme Court did not rule in favor of the commercialization of electronic cigarettes, because the question referred only to its absolute prohibition,” the statement said.

However, the Court’s judgments set a precedent.
