Twitter, however, is asking the businessman to agree that the lawsuit will only last five days.
The Tesla boss terminated a $44 billion takeover deal with the social network earlier this month, accusing the group of breaching its contractual obligations by providing erroneous or incomplete data on the number of fake accounts, among other things. Twitter denied these allegations.
Twitter called for a trial as soon as possible, arguing that any delay hurts the company. According to the social network, Elon Musk did not in any way guarantee that the duration of the trial would not exceed five days, as the Delaware judge ruled.
Lawyers for the businessman did not respond to a request for comment.
